It is only an offence if the purpose is to break the law many behaviours with ASD are a compulsion and sub consciouly done.That is what has to be proven by and solicitor in the land that the child in question understands cause and effect that two and two make four, I still dont always come up with four lolThe children in the news was obviousley represented by someone who had no clue how the autistic mind works,this is what needs addressing in the UK.
